The Agreement
These terms are an agreement between you and Health e Match, PBC, a Delaware public benefit corporation, which operates healthematch.com. By creating a profile or using healthematch.com you agree to them. If you are agreeing on behalf of a practice, you confirm that you are authorized to bind that practice. The Privacy policy is part of these terms.
What healthematch.com Is
healthematch.com makes introductions between patients and practices. A patient builds a profile describing what they are living with and the therapies they are exploring. A practice builds a profile describing what it treats and what it offers. Patients are introduced to practices that treat what they listed. Patients swipe on the practices they like. Practices swipe back. It’s a match, and the two can message each other on healthematch.com.
What healthematch.com Is Not
- Not a healthcare provider. healthematch.com does not provide medical advice, diagnosis, or treatment, and nothing on it should be read as any of those. Only a clinician who has examined you can tell you what is right for you.
- Not a recommendation. An introduction means a practice treats a condition you listed and is within reach of you. It does not mean healthematch.com endorses that practice, that procedure, or that therapy. healthematch.com does not recommend any particular procedure or provider.
- Not a party to your care. Any care that follows a match is between the patient and the practice. healthematch.com is not involved in it and is not responsible for it.
- Not for emergencies. If you need urgent help, contact emergency services. Messages on healthematch.com are not monitored for emergencies.
Who Can Use It
- You must be 18 or older.
- You must be in the United States. healthematch.com makes introductions in the United States only and is not available outside it.
- You must give accurate information and keep it accurate.
- One person, one account. You are responsible for what happens under your sign-in, so keep your password to yourself and tell us if you think somebody else has it.
Patients
A patient’s profile is health information, and you decide who sees it. No practice can see your profile until you swipe on that practice. No practice can contact you until you have matched, and then only on healthematch.com. You can change or remove anything on your profile, pass on any practice, and unmatch at any time.
The regulatory status a practice states for a therapy — FDA-approved, FDA-cleared, investigational, or not FDA-evaluated — is shown to you exactly as that practice documented it. healthematch.com displays it; it does not verify the clinical claims behind it. Ask the practice.
Practices
By creating a practice profile, the practice agrees that:
- Everything on the profile is accurate — the practice name, its locations, its clinicians, their credentials and licenses, the conditions it treats, and the procedures and therapies it offers.
- The regulatory status stated for each therapy is true and will be published to patients exactly as written. Overstating it is grounds for removal.
- healthematch.com may verify the practice by checking the NPI against the federal NPPES registry, screening the practice and its clinicians against the federal exclusion list, and reviewing the documents uploaded. A practice that cannot be verified, or that appears on an exclusion list, will not go live or will be removed.
- Patient information received through healthematch.com is health information that the patient entrusted to us. The practice will use it only to decide whether to swipe back and, after a match, to talk with that patient about their care; will handle it under the laws that apply to the practice, including any that treat the practice as a covered entity; and will not copy it into a marketing list, share it, or contact the patient outside healthematch.com before a match.
- Only the practice’s own staff use its account, and the person who created it is authorized to act for the practice.
Matching and Messaging
Every conversation between a patient and a practice happens on healthematch.com, and only after a match. Both sides agree to:
- Be honest and civil. No harassment, no threats, no discrimination.
- Not use messaging to sell anything unrelated to the patient’s stated needs, and not to send bulk or automated messages.
- Not ask for, or send, payment card numbers, government identifiers, or passwords in a message.
- Not use healthematch.com to reach someone for any purpose other than the care they are exploring.
Either side can unmatch at any time, which closes the conversation. Either side can report the other. healthematch.com may read a reported conversation to resolve the report.
Practice Subscriptions
Building a practice profile, being verified, and going live are free. A practice that wants to keep matching and messaging holds a subscription. The terms of that subscription — the fee, the billing period, and any founding offer — are shown to the practice at sign-up and again when a payment method is requested, and those shown terms govern. In every case:
- Nothing is charged at sign-up, and nothing is charged before the practice’s first match.
- The first match starts a free trial. A payment method is requested then, and the first charge comes only when the trial ends.
- A subscription renews each period until the practice cancels. Canceling stops future charges; fees already paid are not refunded, except where the law requires it.
- If a subscription lapses — the trial ends without a payment method, or a charge fails and is not corrected — the practice cannot open new matches. Conversations already open stay open. Patients are never told why.
- Fees can change. A practice will be told before a change takes effect, and no change applies to a period already paid for.
Patients are never charged for anything on healthematch.com.
What You Post
You own what you write and upload. You give healthematch.com permission to store it, show it to the people these terms say can see it, and keep the records described in the Privacy policy. That permission ends when you delete the content or your account, except for those records.
Do not post anything you do not have the right to post, anything unlawful, or anything that misrepresents who you are or what you offer. Practices must not post patient testimonials or outcome claims that would be unlawful for the practice to make elsewhere.
Removal
healthematch.com can suspend or remove a profile that breaks these terms, that cannot be verified, or that puts a patient or a practice at risk. Where it is safe and lawful to do so, we will say why. You can delete your own account at any time by writing to us.
No Warranty
healthematch.com is provided as it is. We do not promise that any particular practice will swipe back, that any match will lead to care, that a practice’s claims are clinically accurate, or that the site will be available without interruption. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose.
Limitation of Liability
To the extent the law allows, Health e Match, PBC is not liable for indirect, incidental, special, or consequential damages, or for any outcome of care that follows an introduction made on healthematch.com. Our total liability to you for anything arising from these terms or from healthematch.com is limited to the greater of the amount you paid us in the twelve months before the claim and one hundred US dollars. Some states do not allow these limits; where they do not, they apply only as far as the law permits.
Indemnity
A practice agrees to defend and indemnify Health e Match, PBC against claims arising from the care it provides, from information it posted, or from its handling of patient information received through healthematch.com.
Governing Law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction. Nothing here stops either side from seeking an injunction where one is needed to protect a patient’s information.
Changes to These Terms
If these terms change in a way that matters to you, we will tell you by email and on healthematch.com before the change takes effect. Continuing to use healthematch.com after that date means you accept the new terms. The date at the top is the date the current version took effect.
